Over the past month or so, we have been treating quite a few work-related accidents in our clinic in Manassas, VA. What I am noticing is that pretty much everyone who doesn’t understand the system in Virginia pretty much gets screwed ouf of benefits available to them. This is why my manager and myself spent the past few years learning HOW the system works. You see, it’s great just to give good medical and chiropractic care…but after practicing in Manassas, VA for over fourteen years, getting people better became too easy!!
So my staff and I began learning everything we could about the worker’s compensation system from; books, attorneys, books written on the subject by attorneys, the internet, the worker’s compensation commission, and general trial and error.
Most importantly, We also learned THE LAWS of the State, and how to interpret these laws and apply them to help our patients get their medical bills PAID. We are NOT attorneys, but knowing the law always can’t hurt, we figured. Attorneys are their to help you as well, and the good news is in accident cases: the patient doesn’t have to pay them much, if anything, for them to represent your case. One of the biggest scams the insurance carrier adjusters try to pull on claimant’s is moving them to a doctor of THEIR choice. They attempt to interrupt the treatment schedules of our patients because we refuse to play their game…whereas other weaker providers allow the carrier to control their patient’s care and dictate to them what the patient does or does not need. They do this typically by threatening phone calls and SCARE TACTICS…and the most common one is telling the patient that they don’t “Authorize” the treatment or the specific provider.
This is not the law. This is insurance carrier RHETORIC. The law says that the claimant needs a REFERRAL from the treating provider only. That’s IT. Nothing else. NADA. ZIP. ZILCH…NO “Authorization” required.
And WHY does the insurance adjuster fight, kick, scream, and yell when the claimant doesn’t listen to them and goes to the provider whom THEY trust? It’s SIMPLE…The adjuster Knows the law says that they have to pay. AND THEY ALWAYS EVENTUALLY DO!!
But that won’t stop them from INTERFERING and trying to sway the claimant elsewhere to a “insurance-friendly” doctor that is controlled by the carrier…
IN FACT, the reason the carrier denies tests like; MRI’s, CT’s, NCV / EMG’s, X-rays, etc..is because the carrier DOESN’T WANT TO FIND ANYTHING WRONG WITH YOU MEDICALLY!!! Because if something is FOUND…it costs them more money!!
And that is the ONLY thing the carrier cares about. NOT YOU!! NOT YOUR CARE!! ONLY their costs for “closing your case”….and by the way your case should never “CLOSE” anyway…that’s more insurance company RHETORIC and has no basis in the LAWS.
My staff and I also started learning the additional benefits which the insurance carriers always neglect to inform our patients about additional benefits, although usually your attorney will tell you. These include, but are not limited to; mileage reimbursement to and from your doctor appointments, incidental costs associated with your medical bills, etc.
